Manion’s International Auction House Terms, and Conditions

Effective January 1, 2009

    Manion's does not support, condone or in any way try to glorify the government of WWII era Germany or any neo-facist organization. These items are sold for museums, serious collectors, re-enactors, historical organizations, and theatrical purposes only. To view these items, members must log into the website with member number and password, thereby acknowledging our intent.

    Guests

    You are welcome to view the auctions as a registered guest. During registration you will select a password on the guest registration page and Manion's online system will generate your membership number. Your password will appear on a following verification page, please print this page for your records. Your membership number will be sent via email for security reasons. To bid on the auctions you must be a registered Manion's member with a credit card on file.

    Membership

    To bid on auction items, you must join the auction as a member on the “registration / sign up page”. If you have previously signed up as a guest, your membership number and password will remain the same. During member registration you will select a password and Manion's online system will generate your membership number. Your password will appear on the verification. Please print this page for your records. Your membership number will be sent via e-mail for security reasons. You will now be able to bid on all auctions as a Manion's registered member.

    Daily Auctions

    The majority of our auctions run for 14 days and end every evening, 365 days a year, at 8:30 p.m. CST. However, special auctions may run for a longer period, and items may run for a shorter length of time after their initial offering.     Bidding

    Only Manion’s registered members may bid on auction items, having accepted these Terms, and Conditions. 15% final value bidder commission will be added to purchase price. Once you've selected an item of interest you will notice the reserve price, the required bid amount, and the bid entry box:

      • Clicking on the bid button enters your bid at the reserve or next increment.
      • To enter a “proxy” bid you may enter an amount in excess of the reserve or required next increment. The auction program will automatically raise your bid by the bid increment rule, up to the amount of your proxy bid. Other bidders cannot see your proxy bid.
      • The bid increment rule is automatic, and is set at 10% on items priced up to $499.00. Items from $499 to $999 are increased by 5%. Everything above $999.00 is increased by 2.5%.
      • To simulate a live auction environment, “Sniper Proof Bidding" was created by Manion’s, and protects both consignors and bidders. Any bid entered in the last 10 minutes of an auction will extend the closing time by an additional 10 minutes, or until there is no bid for a period of 10 minutes at the final closing. This will continue as long as bidding is taking place. You will see a hammer count down and time remaining on each item as it closes.
      • Bids may be placed at anytime online. If you have a question about bidding, please feel free to contact us between 9:00 a.m. - 4:00 p.m. CST Monday thru Thursday, toll-free at 866.626.4661 or by e-mail: collecting@manions.com. 
      • Questions about auction items can be addressed by telephone Monday – Thursday between 9:00 a.m. and 4:00 p.m CST, or by e-mailing collecting@manions.com.
      • Viewing of auction items is available at our Kansas City facility by appointment only.
      • Placing a bid on Manion's auctions constitutes a binding contract for purchase. Failure to pay for items won is grounds for termination of membership and forfeiture of associated fees. It may also result in collection proceedings via legal procedures.

     Auction Close

    Auction close procedures are as follows:

      • Auctions close daily and invoice weekly on the Wednesday following the auctions.
      • Invoices for the Auction will be available online by 12:00 p.m. CST on the Wednesday following the auction close.
      • Payment for all auctions is due immediately upon invoicing and will be charged to the credit card on file. Special arrangements must be made prior to auction invoicing for alternative payment methods.

    Shipping


      • Our preferred shipping carrier is Federal Express; by default your account is set to use this carrier. At any time you may change this to USPS or Pick-up by visiting your “Account Info” page.
      • If you have purchased multiple items, shipping will be adjusted. This reduction will not be immediately visible.
      • We ship your purchases as quickly as they can be processed after receipt of payment – usually within 3-5 days, but varies with volume.
      • A tracking number is issued when the item is shipped via FedEx. You will be able to follow the status of your order to your door.
      • Shipping charges are made up of the carrier's fee plus insurance and handling costs. The insurance rate is $2.20 for the first $100.00, and $1.00 for each additional $100.00 increment. Handling costs on multiple item shipments will be reduced when possible – call customer service for final shipping cost.
      • DO NOT return damaged items to Manions. You MUST report damaged articles to the carrier (USPS or FedEx). Original papers, boxes and packaging material are REQUIRED to file the insurance claim. FedEx will pick up the damaged item. Items damaged in transit by the USPS should be returned with original box and all packing material to the nearest post office. We have no control on the time period necessary for the carrier to process a claim.
      • All shipments are subject to your local and federal laws and regulations and international customs procedures. International bidders will be responsible for the payment of customs fees.

    Payments


    Payment is due at the time of invoicing.

    Payment by credit card, electronic check, or PayPal is accepted. A valid credit card or checking account number must be kept on file with Manion's International Auction House. This will be used by Manions to satisfy the invoice due. Special arrangements must be made with Manion's to make payment by money order or bank drawn check prior to the close of the auction. All money orders and bank drawn checks must be in U.S. funds.

    Payment for items won by consignors will be taken from available sales unless customer service is otherwise notified.

    Failure to pay when an invoice is due may void return privileges for items on the invoice in question, and will adversely affect your customer status.

    Returns Policy

     

    Our “No Hassle” Returns Guarantee

     

    We want you to be completely satisfied with your purchase. We make every attempt to accurately describe and authenticate all items on the auction, and NEVER knowingly offer reproduction items as original. Our liberal shipping and review policy is the best evidence of our desire to be sure you are happy with your purchase. If you are not 100% satisfied with your purchase during the initial shipping and review period, you may request a Return Material Authorization (RMA) request for full refund (less postage, handling and insurance fees). You must be logged in to submit the RMA request form.


    Shipping and Review Period


      • RMA requests must be made within 17 days (standard days, not business days) from the date of shipment for continental U.S. customers.  This period is called the “initial shipping and review period”, and guarantees a “no hassle” returns policy (except on non-returnable items, see below).  Residents of Hawaii and Alaska must request an RMA within 22 days of shipment.  Due to the shipping times, international customers have 45 days to submit an RMA request.
      • Excessive abuse of the “no hassle” shipping and review period, which is not due to extreme description conflict, may result in a separate restocking charge at the company’s discretion.
      • RMA requests after the initial 17 day shipping and review period (HI & AK, 22 days; international, 45 days) will incur a processing fee of 1% of the realized price for each day past the deadline, for a maximum charge of 13% of the realized price. (Example: if a request for return of a $100.00 item is made 10 days after deadline, then the processing fee would be $10.00). 
      • All sales are considered final after 30 days for continental U.S. customers (35 days for Hawaii and Alaska) and 60 days for international customers.
      • Failure to pay when an invoice is due (see Payments & Bidding) may void return privileges for items on the invoice in question, and will adversely affect your customer status.
    RMA Procedure
      • All RMA requests must go through the online RMA procedure below.  If you are unable to use the online RMA form, please call customer service (Mon - Thu. 9:00 am – 4:00 pm CST) and a representative will file one on your behalf.  No item will be accepted for return without a valid RMA.  
      • Once an RMA form is submitted and approved, you will receive an RMA number via email within 48 hours (not including weekends or holidays), unless filed by customer service. This email must be printed and accompany the return inside the package. The RMA number must also be legibly and boldly written on outside of the package, readily viewable by our receiving department.
      • Items must be returned in their original packaging and original condition. Substitute packaging will not be accepted. 
      • Refunds will be issued per the original method of payment. Please allow a minimum of 30 days to process the return once Manion's has received the item. However, all customers have the option of requesting a Letter of Credit, which can be used IMMEDIATELY for additional purchases.
      • Postage, handling and insurance fees are not refundable.
      • Manion’s is not responsible for return items damaged or lost during shipment.  As the shipper, you must file a claim with the carrier concerned.
    Non-Returnable Items
      • Reproduction Items- Items clearly described as a reproduction or listed in a reproduction category will not be accepted for return.
      • Low-Value Items- Returns will not be accepted for items whose realized price is equal to or less than $20.00.
      • Paper Goods, Books, and Photographs- These items will not be accepted as a return, except in cases of extreme description conflict.

     

    Statement of Polices

     

    Federal Firearms License

    All post-1898 firearms must be shipped to a Federal Firearms License (FFL) holder. If you plan to bid on firearms we suggest that you send your FFL for our records in advance. Questions pertaining to FFL and regulations can be answered at Manion's or your local Bureau of Alcohol, Tobacco, Firearms and Explosives office. Manion's strictly follows all firearms regulations. Manion's must have an original signed copy of the FFL. The firearm may only be shipped to the address on the FFL.

    International customers: If you wish to purchase modern firearms (post 1898 manufacture, firearms parts, or expended ordnance related items) you must make arrangements with a US based firearms exporter. These can be located through a telephone directory or through an Internet search. Manion’s will ship the firearm to your licensed exporter who will then process the necessary State Department of Commerce Department paperwork.

    Firearms classified as “Curio and Relic” (C & R) by the BATFE may be shipped directly to a C & R licensee. For information about how to obtain a C & R license, please contact your local BATFE office. Note: Some states, especially California and New Jersey, may restrict the use of a C & R license.

    All firearms sold by Manion's International Auction House, Inc. are in used condition and are not test fired by representatives of the company. All firearms are examined to verify that they appear to be in functional condition. All firearms should be taken to a licensed gunsmith to verify all NRA safety rules concerning handling of firearms should be followed. This statement applies to all sales regardless of venue.

    California bidders must provide their CFLC number before items will be shipped.

    Authenticity Guarantee Policy

    We make every attempt to authenticate the historic collectibles found on our website, and do so with our best knowledge and good conscience. We will NEVER knowingly offer a reproduction item as an original. As evidence of our honest intent, we offer a very liberal shipping and review policy; however, we do not own the items consigned to our auction, therefore we cannot offer a lifetime guarantee. If the terms of our shipping and review policy are not followed, the sale is considered final.

    Policy on Historic Items

    The items offered for sale or auction by Manion's International Auction House, Inc. are collector items of historical interest intended for preservation, study, and education. The value of collector items is not "use value", or what the item was originally manufactured for; the value is "collector value", for study or collecting - not for use.

    Consignment Instructions


      • Contact a Manion’s consignment representative via telephone, or through our online consignment process, prior to sending any material.
      • A consignment inventory form can be found on our website, or can be requested from Manions via mail, fax, or email. We prefer to use our standard form, but you may create your own as long as it includes all necessary information. Click here for consignment inventory form.
      • Please, no items with reserve price of less than $50. Manion's reserves the right to create acceptable groupings to meet this reserve.
      • If you need help with pricing, identification, shipping or any other procedure feel free to contact us.
      • Submit completed form(s) with consignment. Each packing box should include your list of items.
      • Please affix a number on each item to match the list.
      • Include as much information about each piece of consignment as possible - use additional sheets if necessary.
      • If this procedure is not followed correctly, your consignment could be delayed.
      • Retain copies of each form for your records.
      • All consignment will be processed on a first come first served basis; however, when large consignments are being processed, smaller consignments received will be dispersed throughout. This process takes approximately 30 days due to volume of consignment received.
      • We will follow your instructions as closely as possible.
      • Manion's reserves the right to utilize photographic images of items submitted for consignment, or potential consignment, for marketing, research, or educational purposes.
      • Re-runs will be processed as quickly as possible.
      • Price reductions on re-runs are suggested at 20%.
      • Question about reserve price & description MUST be addressed at least 24 hours before the close of the auction.
      • All items consigned to Manion’s International Auction House become our property, and are under our care and keeping until sold or returned to the consignor. This is necessary for insurance purposes.
      • Removal of an item from a live auction will result in the consignor being charged the bidder and consignor commission.
      • Consignors are responsible for transportation expenses to the auction house and return of un-sold items.
      • Estates and collections can be picked up by arrangement.
      • All questions regarding final pay-off must be made within 30 days of check receipt. After this, all auction books are closed.
      • After auction closes you will be able to view your sold/unsold list from the “consignor info” web page, or you can request a list from customer service.
      • Manion's will also collect consignment at various locations and shows attended throughout the year.
      • A Transportation Service Fee will be charged for items consigned during collector shows and other situations involving significant travel by Manion's representatives. This nominal fee is intended to offset transportation expenses.

        Fee Rates:
          $5.00 Minimum - 10lbs or less
          .50 cents per lb for 10lbs or more

        These items will be weighed upon arrival at our facility, and the amount deducted from consignor sales when applicable.
      • Payment for items won by consignors will be deducted from available sales (at our discretion) unless customer service is otherwise notified.
      • In the event of an auction problem, i.e. hardware or software that keeps a bid from being placed or otherwise interfered with the auction process, any items affected will be withdrawn and rerun in a different auction.
      • A $2 per lot number handling charge will be assessed for items returned to consignors in the United States; fees for international customers vary. We encourage consignors to assign realistic reserve bid prices.

    Consignor Fees

     

    Consignor fees are 25% of the realized price of an item. Alterations can be made for complete collections and items of extreme interest and value. Consignor fees cover a broad range of services necessary to bring your items to a worldwide market:

     

      • We assign a unique bar-code serial number
      • Inventory and storage
      • Insure
      • Wrap and protect
      • Photograph
      • Describe
      • Warehouse the items
      • Answer all e-mail and phone calls from bidders
      • Invoice
      • Collect payments
      • Pack and ship all orders
      • Process all returns

     

    Re-consignment Policy

     

      Except in the case of a buyer’s death and estate liquidation, items purchased from Manion’s cannot be returned to the auction for re-sale for a period of 365 days from the date of shipment.  In the rare event we make an exception to the policy, we reserve the right to delay posting the item(s) on the auction for the full 365 day period from the date of shipment.  This policy will apply to both U.S and international customers.



    Restricted Items


      • Items in glass enclosures, including all framed items, will be accepted but are shipped at your risk; they are not covered by insurance.
      • All firearms requiring an FFL will be consigned only in accordance with BATF rules. Manion's reserves the right to reject any firearms.
      • Manion’s does not accept live flares, explosives, live pyrotechnics or live primers. Inert ordnance is accepted only if disassembled.
      • No reloaded ammunition.
      • Sporting or military ammunition is accepted only if in full, original packaging of same type and caliber.
      • No corroded or damaged ammunition.
      • No incomplete containers or mixed lots of ammunition. If less than full packages are received, they will be disposed of and will not be returned.
      • Reproduction items represented or priced as original.
      • No “hate” material of current publication. Historic artifacts of a biased nature may be accepted on the condition it is of educational value and with the understanding Manion’s does not endorse or promote the views expressed therein.
      • No sexually explicit material.
      • No human body parts.
      • No endangered animal material.
      • Manion’s reserves the right to reject any item.

    Disclaimer of Warranties

     

    You expressly understand and agree that:


      1. Your use of this service is at your sole risk. The service is provided on an “as is” and “as available” basis. Manion’s expressly disclaims all warranties of any kind, whether expressed or implied, including, but not limited to the implied warranties of merchantability, fitness, for a particular purpose, and non-infringement.
      2. Manion’s makes no warranty that the service will meet your requirements or that the service will be uninterrupted timely, secure, or error-free. The results that may be obtained from the use of the service will be accurate or reliable, the quality of any products, services, information, or other material purchased or obtained through the service will meet your expectations, and any errors in the software will be corrected.
      3. Any material downloaded or otherwise obtained through the use of the service is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
      4. No advice of information whether oral or written, obtained by you from Manion’s or through or from this service shall create any warranty not expressly stated in the conditions above.

    Limitation of Liability

     You expressly understand and agree that Manion’s shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damage for loss of profits, goodwill, use, data, or other intangible losses (even if Manion’s has been advised of the possibility of such damages), resulting from: the use or the inability to use the service; the cost procurement of substitute goods and services resulting from any goods, data, information or services purchase or obtained or message received or transactions entered into through or from the service unauthorized access to or alteration of your transmissions or data; statements or conduct of any third party on service; or any other matter relating to the service.

    Exclusions and Limitations

      Some jurisdictions do not allow the exclusion of certain warranties of the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations or section may not apply to you.
